Abstract : This thesis titled, "Theory of Incomplete Contract," examines the concept of completing the legal contract in the cases where essential elements have not been addressed initially by either of the contracts parties, which is a topic of great legal importance at the present time. In particular, this thesis sheds light on the role of the judiciary branch in such cases in terms of the legal and customary sources and rules, especially given the proliferation of judicial applications/interventions with regard to contracts in these cases. Additionally, the thesis examines the basis and methods for contract completion—Listing contracts completions pros and cons by examining a few cases of its implementation, particularly with regard to the contracts obligations soundness and fairness. Finally, this thesis suggests several recommendations regarding incomplete contracts, most importantly that the judiciary branch in the Kingdom of Saudi Arabia ought to intervene in the case of incomplete contracts if requested by one of the contracting parties in order to complete the contract.
